Terms and conditions for the letting of the Châlet apartment and the Schafstall studio
These rental terms apply to all contracts for the short-term letting of the holiday properties Châlet apartment and Schafstall studio at Hohneggweg 47, 3906 Saas-Fee. The landlord is Frank Bumann (the «landlord»). The tenant is the person making the booking, who is also liable for the conduct of accompanying persons. Deviating terms of the tenant apply only insofar as they have been acknowledged in writing.
The presentation of the properties on this website does not constitute a binding offer. The rental contract is concluded upon the booking confirmation issued by the landlord or by the booking system engaged by him. The details displayed during the booking process regarding period, number of persons and price form part of the contract.
The prices displayed during the booking process, in Swiss francs, are authoritative. The price displayed is the price actually payable and includes all non-optional surcharges; the visitor’s tax is stated separately in accordance with Art. 11 of the Swiss Price Disclosure Ordinance. For direct bookings made through this website a discount of 10 per cent is granted against the prices shown on intermediary portals.
Payment terms depend on the rate booked and are displayed during the booking process and in the booking confirmation:
– For refundable rates an advance payment is charged; the amount and the payment deadline follow from the booking confirmation. The balance is payable at the time stated there.
– For non-refundable rates the full amount is charged at the time of booking.
If payment is not received by the deadline communicated, the landlord is entitled, after prior reminder, to withdraw from the contract and to let the accommodation to another party.
The Châlet apartment may be occupied by a maximum of six persons and the Schafstall studio by a maximum of four persons; in the studio an additional sofa bed for a fifth person is available on request. Overoccupancy entitles the landlord to refuse admission to the persons concerned or to terminate the contract with immediate effect. Subletting or transfer to third parties, whether for consideration or not, is prohibited.
Saas-Fee is car-free; the property is reached on foot or by electric taxi. Personal check-in takes place until 4 p.m. at Hohneggweg 47, including assistance with luggage over the final 100 metres or so. Arrival after 4 p.m. is perfectly possible; access is then by key box, the code for which is communicated in advance, but without personal reception and without assistance with luggage. On the day of departure the property is to be handed back swept clean by 10 a.m.; a later check-out is possible on request and subject to availability, but gives rise to no entitlement. Dishes are to be cleaned and put away and waste disposed of.
For damage to the apartment and its furnishings during the stay, the tenants of the apartment are liable without limitation. A deposit payment may be required at check-in. Damage is to be reported to the landlord without delay. The deposit is refunded once the property has been handed back in proper condition; the landlord is entitled to set off against it any damage established, extraordinary cleaning expense or outstanding amounts. Further claims are reserved.
Smoking is strictly prohibited in both properties. Pets are generally not permitted; uncomplicated animals may be brought subject to prior agreement. In that case they may not use sofas or beds, and the property is to be handed back clean and free of hair. In the event of soiling caused by an animal a cleaning fee of CHF 200 is charged. Local quiet hours are to be observed. The landlord is entitled to enter the property in the event of imminent danger or in order to carry out necessary work.
Cancellation, rebooking and failure to arrive are governed by the conditions of the rate booked. Whether a rate is refundable, and the deadline within which cancellation free of charge is possible, is displayed during the booking process before the contract is concluded and communicated with the booking confirmation. Non-refundable rates give rise to no refund in the event of cancellation or failure to arrive; the full amount remains payable. For refundable rates any compensation is governed by the deadline stated for the rate booked. Cancellation must be made in text form; the time of receipt by the landlord is authoritative. Early departure or late arrival give rise to no claim for a refund. Taking out travel cancellation insurance is recommended.
The landlord is liable for damage only in cases of intent or gross negligence; otherwise liability is excluded to the extent permitted by law. Liability for personal injury and any further mandatory statutory liability remain reserved in every case. No liability is accepted for valuables brought onto the premises, for temporary impairments such as interruptions to electricity, water or internet, for construction noise or emissions in the neighbourhood, or for events of force majeure, in particular weather conditions, avalanche risk, road closures or official orders. Statements regarding snow conditions, ski-in and ski-out are non-binding empirical values and do not constitute a warranted characteristic.
Swiss law applies exclusively, to the exclusion of its conflict-of-law rules and of the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Saas-Fee. The mandatory and partly mandatory fora are expressly reserved, in particular the consumer forum under Art. 32 in conjunction with Art. 35 of the Swiss Civil Procedure Code and the jurisdiction rules of the Lugano Convention; consumers may in every case bring proceedings at their place of residence and may be sued only there. Should any provision of these rental terms be invalid, the validity of the remaining provisions shall remain unaffected; the statutory rule shall take the place of the invalid provision.

No evaluation for other purposes, no combination with further data and no identification of individual persons takes place. Deletion is carried out by the hosting provider after a short period.
The KUBE system of Seekda GmbH, Austria, is used for availability enquiries and bookings. In order to display it, the visitor’s browser loads a script from the servers of Seekda GmbH; the IP address is thereby transmitted to Seekda GmbH even before any enquiry is made. Seekda GmbH may set cookies required for carrying out the booking process. In accordance with Art. 45c lit. b of the Swiss Telecommunications Act, attention is drawn to the fact that this processing may be refused: the setting of cookies can be restricted or prevented in the browser settings, and cookies already set can be deleted. Where contact is made by e-mail or telephone, the details transmitted are processed for the purpose of dealing with the enquiry and of preparing a contract. E-mail traffic is handled by the controller’s mail provider. The legal basis is Art. 31 para. 2 lit. a revDSG and Art. 6 para. 1 lit. b GDPR respectively, and otherwise the overriding interest in answering enquiries.
Personal data are disclosed only insofar as this is necessary for the performance of the contract or required by law, in particular to the processors named above and to the authorities within the scope of the reporting obligations applicable to accommodation providers. Personal data are not sold. Seekda GmbH is domiciled in Austria; in the assessment of the Swiss Federal Council the European Union affords adequate data protection, so that no additional safeguards are required for this disclosure.
Personal data are retained only for as long as the respective processing purpose requires or statutory retention obligations demand. Server log files are deleted by the hosting provider after a short period. Booking and correspondence data are retained for the duration of the contractual relationship and the statutory periods following from it, and are deleted thereafter.
Data subjects have, in accordance with the applicable law, the right to information, rectification and erasure and the right to have their data handed over or transferred. Persons within the scope of the GDPR additionally have the right to restriction of processing and the right to object to processing. The website is delivered exclusively in encrypted form (HTTPS). As the controller does not operate a server of his own, the technical and organisational security measures are incumbent on the processors engaged. Absolute security of data transmission over the internet cannot be guaranteed.
The mere use of this website requires no provision of personal data; the log files referred to in section 3 arise for technical reasons. For a booking, the provision of the data marked as required in the booking form is contractually necessary. Without these details no rental contract can be concluded and no booking confirmed. A statutory obligation to provide data exists within the scope of the reporting obligations applicable to accommodation providers.
Automated individual decision-making, including profiling, within the meaning of Art. 21 revDSG and Art. 22 GDPR does not take place.
